NEW ZEALAND TEACHERS COUNCIL
(MAKING REPORTS and COMPLAINTS) RULES 2004

The New Zealand Teachers Council is seeking to amend the New Zealand Teachers Council (Making Reports and Complaints) Rules 2004.

The proposed amendment is adding a new subsection to Rule 9(1)

"any conduct that brings or is likely to bring discredit to the profession".

The Council proposes to amend the Rules as cases coming before the Complaints Assessment Committee and the New Zealand Teachers Disciplinary Tribunal have revealed gaps in the present criteria. The Disciplinary Tribunal has, through its decisions, considered a definition of serious misconduct however; the Council is of the opinion that this general definition can be more easily applied to a factual situation. The Council has also noted that similar definitions are used by other jurisdictions. It encompasses those cases of serious behaviour not predicted or covered in the present rules.

As required by the New Zealand Teachers Council (Amendment and Replacement of Rules) Rules 2004, the Council must consult with interested parties as to their effect.

Any person may make a submission on the proposed amendment to the New Zealand Teachers Council (Making Reports and Complaints) Rules 2004. Submissions are required to be received by the New Zealand Teachers Council by 28 March 2008.

Every submission must:

(a) be typed; and

(b) give the name, address, and telephone number of the individual or organisation making the submission.

If the submission is made by an organisation named in the Schedule or by any other organisation, it must be signed by a person on behalf of the organisation, and the person must certify that:

(a) the submission reflects the views of the organisation; and

(b) the person signing is authorised to do so.
